By accessing and using VERTIQ, you accept and agree to be bound by the terms and provision of this agreement.
VERTIQ grants you a limited, non-exclusive, non-transferable license to use the service for your internal business purposes.
VERTIQ provides LEED certification analysis and building performance optimization tools. The service is provided "as is" without warranties of any kind.
IMPORTANT: VERTIQ does not guarantee LEED certification approval. Our analysis tools provide guidance based on available data, but final certification depends on USGBC review.
The information provided by VERTIQ should not be considered as professional architectural or engineering advice.
VERTIQ provides access to its feasibility and project workflow tools under access arrangements confirmed between Everpoint Inc. and the user or their organization. Pricing for full project workflow access is provided by quote or order confirmation and may vary based on project scope, team size, and access level.
The LEED feasibility calculator is available free of charge with no account required. Access to full project analysis, evidence management, and report export requires a confirmed access arrangement. Pricing terms are communicated directly and are not publicly listed.
Everpoint Inc. reserves the right to update access terms with reasonable notice. Confirmed access arrangements in effect at the time of any change will be honored for the duration of that arrangement.
If you are not satisfied with a paid access arrangement, you may request a refund within 14 days of payment confirmation by emailing admin@everpoint.net. Refunds are processed via the original payment method and typically appear within 5-10 business days.
Access arrangements that have been fully consumed (e.g., analysis runs completed, reports exported) may not be eligible for full refund at Everpoint Inc.'s discretion.
In no event shall Everpoint Inc. be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
You retain all rights to your project data, documents, and uploads. VERTIQ processes this content as necessary to provide features such as document extraction, analysis, evidence management, and report generation.
VERTIQ does not sell your data or make it public. We provide data to service providers only when necessary to host, store, secure, or analyze it on VERTIQ's behalf, or when required by law.
VERTIQ personnel do not routinely access project content. Access through the VERTIQ application requires explicit project collaborator membership. Limited infrastructure-level access may be required for security incident response, legal compliance, or service recovery. VERTIQ does not use project content to train general-purpose AI models and does not authorize its service providers to do so without the user's explicit prior consent.
VERTIQ will treat non-public project content as confidential and will use it only to provide, secure, support, and legally operate the service, subject to the Privacy Policy.
You agree not to use VERTIQ to:
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever.
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
